The Employment Equity Act Amendments are scheduled to take effect on January 1, 2025.
IMPORTANT: Please note that the amendments do not affect the current 2024 reporting requirements, that are still based on the existing section 21 of the EE Act.
The amendments will introduce various changes including two more important changes being:
- Sectoral numerical targets
The Minister of Employment and Labour will be able to set targets for economic sectors to ensure that historically disadvantaged groups are represented equitably in the workforce.
- Reduced application for some sections
Certain sections of the Employment Equity Act will only apply to a smaller group of employers, which will reduce the administrative burden on smaller businesses.
The amendments also include:
- Removing the requirement for psychological testing and similar assessments to be certified by the Health Professions Council of South Africa
- Providing for a certificate from the minister confirming an employer’s compliance with the act
The Department of Employment and Labour (DEL) issued draft regulations for comment in February 2024. The draft regulations include:
- Setting annual numerical targets for upper and lower occupational levels
- Clarifying that the National EAP applies to designated employers that operate nationally
